Alert from CDFF Legal Counsel: Fitness-For-Duty Evaluations

1. An employee must be ordered to attend a fitness-for-duty evaluation by someone in that employee's chain of command
2. Employees cannot be required to waive their medical privacy and confidentiality rights as part of a fitness-for-duty evaluation
3. Do NOT sign a waiver of confidentiality without talking to the State Rank-and-File Representative (Ken Hale) or the State Supervisory Representative (Fred Flores)
Something disturbing is occurring in CAL FIRE with respect to fitness-for-duty evaluations. Whenever you are ordered to a fitness-for-duty evaluation, you should immediately contact the State Rank-and-File Representative (Ken Hale) or the State Supervisory Representative (Fred Flores)
CAL FIRE is entitled to order its employees to attend and cooperate with fitness-for-duty evaluations (medical or psychological) pursuant to Government Code section 19253.5(a). However, an employee is not required to attend a fitness-for-duty evaluation in the absence of an order to do so from someone in the employee's chain of command. Additionally, some basis should be given for the order to attend a fitness-for-duty evaluation.
Although CAL FIRE does have the authority to order employees to attend and cooperate with fitness-for-duty evaluations, employees subject to such evaluations do not waive their confidentiality rights with respect to their medical records. Recently, we have seen some disturbing attempted violations of employees' confidentiality rights when it comes to fitness-for-duty evaluations.
You have a constitutional right to privacy which you do not lose by virtue of becoming a public employee. Long Beach City Employees Association v. City of Long Beach, 41 Cal.3d 937, 951 (1986). California law generally prohibits a health care provider from disclosing medical information regarding a patient without first obtaining the patient's authorization. Civil Code § 56.10(a). A limited exception exists for fitness-for-duty evaluations performed at the employer's written request and expense.
Civil Code section 56.10(c)(8)(B) states:
. . . (c) A provider of health care may disclose medical information as follows:
. . . (8) A provider of health care that has created medical information as a result of employment-related health care services to an employee conducted at the specific prior written request and expense of the employer may disclose to the employee's employer that part of the information which:
. . . (B) Describes functional limitations of the patient that may entitle the patient to leave from work for medical reasons or limit the patient's fitness to perform his of her present employment, provided that no statement of medical cause is included in the information disclosed.
Based on the above statutory provision, unless you authorize a greater release of information, doctors or any other providers of health care performing fitness-for-duty evaluations can only report to CAL FIRE whether the you are fit or unfit to perform the duties of your position and describe functional limitations that may restrict your ability to perform your job. No other information may be released to CAL FIRE, or anyone else. In fact, we typically recommend that an employee scheduled for a fitness-for-duty evaluation bring to the evaluation a letter from CDFF or legal counsel, setting forth their rights to confidentiality and a statement that they are not waiving any rights. Additionally, that letter typically contains a statement that the individual will not execute an authorization allowing the doctor or any other provider of health care to release more information than permitted by Civil Code § 56.10(c)(8)(B).
Recently, a CAL FIRE employee was presented with a waiver by one of the CAL FIRE selected medical providers, which would have waived all confidentiality with respect to the evaluation, communications between the medical provider and the employee, and all of the employee's medical records (including those received from third parties). The waiver would have allowed the medical provider to disclose far more information than Civil Code section 56.10(c)(8)(B) allows, and would have authorized the medical provider to disclose that information to virtually anyone, without limitation. Based on the language of the waiver, the one person who would not have access to the results of the evaluation, the reports, the medical records, and all other information would be the employee himself.
When presented with a waiver like this, or any waiver relating to a fitness-for-duty evaluation, we recommend that you contact your CDFF representative, Ken Hale or Fred Flores, prior to considering signing. In many cases we would recommend that you NOT sign any waiver broader than what is required under Civil Code section 56.10(c)(8)(B).
In sum, although CAL FIRE may order you to attend and cooperate with medical and psychological fitness-for-duty evaluations, it must not only advise you of the basis for that order, but it must also ensure that such an evaluation does not require you to waive your right to confidentiality in your medical records and information.

Special Notice To Members

Hearing Held On Bargaining Bill

March 10, 2010 -- A House Education and Labor Subcommittee held a hearing March 10 on the IAFF’s national collective bargaining bill, HR 413, the Public Safety Employer-Employee Cooperation Act, setting the stage for action in the House.

IAFF Holds Successful Political Training Academy

March 10, 2010 -- IAFF members from 31 states and three Canadian provinces attended the IAFF 14th annual Political Training Academy (PTA) in Baltimore, Maryland, February 28-March 5. In addition, the 2010 class included five female IAFF members – the most ever – two of whom currently serve as presidents of their locals.

National Ban on Flame Retardant Chemicals

March 9, 2010 -- Over the past several months, the IAFF has been working with the chemical industry to structure a national withdrawal of the controversial brominated flame retardant, Decabromine, from the market. “The IAFF is proud that we played a major role working with our congressional and administration allies and with the major manufacturers of flame retardant chemicals to ban Decabromine from the market by the end of 2013,” says IAFF General President Harold Schaitberger.

DHS Releases FIRE Act Grant Workshop Schedule

March 9, 2010 -- The Department of Homeland Security (DHS) has posted the schedule for applicant workshops for 2010 Assistance to Firefighters (FIRE Act) grants. The schedule will be updated daily with any new/updated information about the scheduled workshops. The IAFF encourages affiliates to work with their fire departments to apply for FIRE Act grants, which help fund training, equipment, protective gear and emergency vehicles.

March 9, 2010 -- The IAFF 17th Canadian Legislative Conference is fast approaching, and affiliates planning to attend are reminded to complete their Conference registration, make hotel reservations and make lobby day appointments with members of Parliament. The Conference is scheduled for April 25-28, 2010, at the Delta Ottawa Hotel. Conference brochures were mailed from the Canadian office to affiliate presidents and secretaries.

Status Update on FAA Reauthorization

March 8, 2010 -- The United States Senate is expected to consider S. 1451, the Federal Aviation Administration (FAA) Air Transportation Modernization and Safety Improvement Act, in March 2010. S. 1451 is the Senate version of FAA Reauthorization bill H.R. 915, which passed the U.S. House of Representatives in 2009. Unlike the House-passed bill, S. 1451 does not contain IAFF-backed language requiring the FAA to bring Airport Rescue and Fire Fighting (ARFF) standards into conformity with existing national consensus standards.

MDA Releases 2010 Summer Camp Schedule

Every year, the Muscular Dystrophy Association (MDA) supports some 90 summer camps across the country for children with neuromuscular diseases. MDA camp offers a wide range of activities specially designed for young people who have limited mobility or use wheelchairs. Although structured, camp programs are conducted in a relaxed atmosphere that gives campers an unmatched opportunity to develop lifelong friendships, share interests and build self-confidence.

Fire Department Network News Features IAFF-MDA Boot Camp

February 18, 2010 -- For more than 50 years there has been a partnership between the International Association of Fire Fighters (IAFF) and the Muscular Dystrophy Association (MDA). MDA is the IAFF's "Charity of Choice," and so far more than $450 million has been raised by fire fighters and their Fill-the-Boot campaigns, making them the greatest contributor to MDA. To run a successful campaign, every department or local must have a coordinator, and once a year, MDA holds a boot camp for those coordinators.

President's Budget Provides Funding for Fire Service Programs

February 1, 2010 -- The White House has unveiled the president's proposed budget for Fiscal Year 2011. The proposal includes $305 million for the Staffing for Adequate Fire and Emergency Response (SAFER) grant program, $305 million for Assistance to Firefighters (FIRE Act) grants, $28 million for Urban Search and Rescue (US&R) and more than $2 billion to state governments and urban areas to improve their emergency response capabilities.

IAFF Recognizes Manitoba Premier for Legislative Efforts

January 21, 2010 -- IAFF General President Harold Schaitberger and fire fighters from Manitoba and Alberta presented former Manitoba Premier Gary Doer with a plaque January 21 in recognition of his legislative efforts on behalf of the province’s first responders. “Please accept this as a token of our appreciation for everything you’ve done for fire fighters over the years,” Schaitberger said during a ceremony at IAFF headquarters.

Updated Message from General President Schaitberger on Excise Tax

January 14, 2010 -- We are fully aware of the media reports this afternoon that there has been a deal reached between "labor," the White House and Congressional leaders on the excise tax in the health care reform legislation being debated. On a conference call with the AFL-CIO Executive Council just minutes ago, AFL-CIO President Richard Trumka provided a report that outlined that purported "deal." Let me state right here that this IAFF was not afforded an opportunity to be a part of the labor committee that participated in negotiations with the White House and Congressional leaders over the changes that are being reportedly made to the excise tax provision in the bill.
